Warranty A Warranty is only as good as the Company behind it. Unfortunately, there is virtually no guarantee that a warranty promise will be honored appropriately, quickly, with a minimum of bother. A purchaser of shade canopies should consider not only the financial strength of the supplier, but also its track record in dealing with warranty claims. This is best checked by contacting past and current customers. Term Warranties are generally limited to a specified number of years. It is not unusual that the various elements affected by a covered by warranty would be for different terms. For example, one Shade company warrants the structural integrity of their steel members for 20 years, fabric for six years, and workmanship and painted surfaces to twelve months. Exclusions Warranties generally contain clauses that limit a manufacturer's liability. Common exclusions include Acts of God such as unusual winds, rain, or other weather events; vandalism; abuse or misuse; or fire. Some shade companies void their warranties if changes, additions, modifications, or attachments are made to the shade units. Covered Items Warranties can apply to, or be restricted to, each of the various components of a shade canopy : Design. The installation should meet the building codes and engineering requirements that are established by law or contract, including load expectations for wind, snow, etc. The purchaser should require sealed plans/calculations from a professional engineer registered in the state where the project is located. Workmanship. If the design is correctly engineered, the structure should meet all contracted and legal conditions if it is properly constructed. Component Parts. In most cases, shade companies pass on manufacturers' warranties to the purchaser. In some cases, the warranty on a specific component may be limited to certain attributes. For example, the larger fabric manufacturers provide a ten year warranty for UV protection, but generally do not warrant color fastness for any significant period. There may be limitations related to a specific component such as a specific wind speed for fabric. The warranty may cover the material alone, not the labor to remove or correct the problem. Proration Most shade companies' warranties are prorated. In other words, the amount of recovery is limited to a ratio of the total cost based upon the past life of the structure. In other words, a loss in the fourth year of a five year warranty period might limit recovery to forty percent (40%) of the initial cost of the structure. If possible, a purchaser should seek a "non-prorated" warranty. If the loss occurs during the life of the warranty, the claimant is entitled to the lesser of the cost of the structure when built or its replacement cost.
