Warranty

The AmeriShade Warranty & Guarantee

SHADE STRUCTURE WARRANTY

Amerishade Inc. warrants all workmanship and materials for a period of ten (10) years from the substantial completion; the first five (5) years of which period are a NON-PRORATED warranty. The only exclusions are Acts of God (i.e. hurricanes, tornadoes, micro-bursts, etc): weather patterns that exceed the average mean for that geographical location of the installation as determined by the National Weather Service; misuse of the structure or its components for purposes other than weather protection; or physical abuse. Warranty is limited to the specific building code requirements for the geographical location of the installation unless purchaser has specifically ordered and paid for the engineering/workmanship/materials required to exceed the building code.

Amerishade Inc.’s shade cloth is warranted for five years against failure due to deterioration, break down, mildew, heat, cold, fading or discoloration with the exception of the colors "red" and "burgundy" which have a three year (3) warranty.

Warranty owner shall notify Amerishade, Inc. in writing of any warranty claim. Warranty is non-transferable unless authorized and agreed to by Amerishade, Inc. in writing. Amerishade, Inc. reserves the right to repair or replace any item at their option. Amerishade, Inc. shall not in any event be liable for indirect, special, consequential, or liquidated damages.

The warranty set forth above shall be the purchaser’s sole and exclusive warranty.

Explanation of Warranty Details

A Warranty is only as good as the Company behind it.

Each officer, employee, and associate of Amerishade, Inc. recognizes that you have a choice in companies to implement your shade project. We value our customers’ satisfaction with a job well done. If you would like to verify this, we would be happy to provide you with a list of customers as references.

Term

While some shade companies prorate the warranty from the first year, we provide full warranty coverage for the first five years. The manufacturers’ warranty on the fabric and thread is passed on the customer. All metal components and workmanship are warranted for ten years, prorated only from the sixth year on (more on Proration below). The warranty does not extend to the paint.

Exclusions

The exclusions to the AmeriShade warranty are generally damage resulting from causes beyond AmeriShade’s control – "Acts of God" such as unusual winds or other weather events that are outside the average parameters of normal weather for an area; vandalism; abuse or misuse; fire.

Covered Items

The shade fabric and thread are covered by the manufacturer’s warranty. All metal components and workmanship are covered by Amerishade, Inc. Exceptions to this are any changes, additions, modifications, or attachments made to the shade units by person(s) other than AmeriShade representatives. Also, any changes, additions, modifications, or attachments made to the shade units by person(s) other than AmeriShade representatives that directly or indirectly affects the integrity of the rest of the AmeriShade structure voids the AmeriShade warranty.

Design.

AmeriShade, Inc. uses only licensed canopy engineers to review the plans for a modern cable tensioned shade structure including design, framework, connections and site location. We purposely do not employ a structural engineer on staff – we rely exclusively on independent, professional engineers licensed in the state where the project is located. Our engineer consultants are not beholden to us or intimidated; they put their professional integrity and liability on the line for every project.

Proration

Most shade companies’ warranties are prorated. In other words, the amount of recovery is limited to a ratio of the total cost based upon the past life of the structure. For instance, a loss in the fourth year of a five year warranty period might limit recovery to as little as 20% of the initial cost of the structure.

AmeriShade, Inc. offers full warranty during the first five years. That means that any legitimate warranty claim is paid or replaced with 100% of the cost borne by AmeriShade. After five years, the proration begins with a 20% reduction each year.

Limitation on Damages

In the event of a warranty claim, AmeriShade, Inc. reserves the right to determine if the warranty will be satisfied by a refund, repair, or replacement.
